11、劳务分包人义务 Labor subcontractor’s obligations
11.1、对本合同劳务分包范围内的工程质量向工程承包人负责，组织具有相应资格证书的熟练工人投入工作；未经工程承包人授权或允许，不得擅自与发包人及有关部门建立工作联系；自觉遵守环球鞋网为您整理以下法律法规及有关规章制度；
Be responsible to the project contractor for the project quality within the scope of labor subcontracting under this contract, and organize skilled workers with corresponding qualification certificates to carry out work; shall not, without the authorization or permission of the project contractor, to establish working contact with the employer and relevant departments, consciously abide by laws, regulations and relevant rules and regulations;

11.2、劳务分包人根据施工组织设计总进度计划的要求，每月底前

The labor subcontractor shall, in accordance with the requirements of the overall schedule of the construction organization design on days prior to the end of each month submit the construction schedule for the next month or the stage construction schedule if required. 11.5、按工程承包人统一规划堆放材料、机具，按工程承包人标准化工地要求设置标牌，搞好生活区的管理，做好自身责任区的治安保卫工作；

11.7、做好施工场地周围建筑物、构筑物和地下管线和已完工程部分的成品保护工作，因劳务分包人责任发生损坏，劳务分包人自行承担由此引起的一切经济损失及各种罚款；
The labor subcontractor shall complete the finished product protection work of the surrounding buildings, structures and underground pipelines and finished engineering part in the construction site in addition to bear all the economic losses and all kinds of fines due to the damage which arising therefrom;

11.8、妥善保管、合理使用工程承包人提供或租赁给劳务分包人使用的机具、周转材料及其他设施；
Shall safekept, reasonable use of the machinery, turnover materials and other facilities which provided or leased by the engineering contractor;

11.9劳务分包人须服从工程承包人转发的发包人及工程师的指令。
The labor subcontractor shall obey the instructions of the employer and the engineer forwarded by the project contractor.

11.10除非本合同另有约定，劳务分包人应对其作业内容的实施、完工负责，劳务分包人应承担并履行总（分）包合同约定的、与劳务作业有关的所有义务及工作程序。
Unless otherwise stipulated herein, the labor subcontractor shall be responsible for the implementation and completion of its operation contents, and the labor subcontractor shall undertake and perform all obligations and working procedures related to labor operation as stipulated in the general (sub-) contract.

12、安全施工与检查 Safe construction and inspection
12.1、劳务分包人应遵守工程建设安全生产有关管理规定，严格按安全标准进行施工，并随时接受行业安全检查人员依法实施的监督检查，采取必要的安全防护措施，消除事故隐患。由于劳务分包人安全措施不力造成事故的责任和因此而发生的费用，由劳务分包人承担。
Labor subcontractors shall abide by the relevant management regulations of engineering construction safety production, carry out the construction in strict accordance with safety standards, and at any time to accept the supervision and inspection of industry safety inspectors pursuant to the law, and take necessary safety protection measures to eliminate hidden dangers of accidents. The labor subcontractor shall bear the responsibility for the accident in addition to the expenses incurred therefrom due to its ineffective safety measures.

12.2、工程承包人应对其在施工场地的工作人员进行安全教育，并对他们的安全负责。工程承包人不得要求劳务分包人违反安全管理的规定进行施工。因工程承包人原因导致的安全事故，由工程承包人承担相应责任及发生的费用。
The project contractor shall carry out safety education for its staff and employees on the construction site and be responsible for their safety and shall not require the labor subcontractor to carry out construction in violation of safety management regulations. For safety accidents caused by the project contractor, the project contractor shall bear corresponding responsibilities and expenses incurred.

13、安全防护 Safety Protection
13.1、劳务分包人在动力设备、输电线路、地下管道、密封防震车间、易燃易爆地段以及临街交通要道附近施工时，施工开始前应向工程承包人提出安全防护措施，经工程承包人认可后实施，防护措施费用由工程承包人承担。
Labor subcontractors shall, prior to construction, put forward to the project contractor of safety protection measures on the area?s with power equipment, transmission lines, underground pipelines, sealed shockproof workshop, inflammable and explosive areas and street traffic arteries near the construction, and implement the work after approved by the project contractor, and the cost of protective measures shall be borne by the project contractor.

13.2、实施爆破作业，在放射、毒害性环境中工作（含储存、运输、使用）及使用毒害性、腐蚀性物品施工时，劳务分包人应在施工前10天以书面形式通知工程承包人，并提出相应的安全防护措施，经工程承包人认可后实施，由工程承包人承担安全防护措施费用。
For the implementation of blasting operations, work in radioactive and toxic environment (including storage, transportation, use) and the use of toxic and corrosive materials construction, labor subcontractor shall, ten days prior to construction, notify the project contractor in writing, and put forward the corresponding safety protection measures which being implemented subsequent to approval of the project contractor which shall bear the cost of safety protection measures.

13.3、劳务分包人在施工现场内使用的安全保护用品（如安全帽、安全带及其他保护用品），由劳务分包人提供使用计划，经工程承包人批准后，由工程承包人负责供应。
The labor subcontractor shall provide the use plan for the safety protection articles (such as safety helmet, safety belt and other protection articles) used in the construction site by the labor subcontractor, which shall be supplied by the engineering contractor upon the approval of the engineering contractor.

14、事故处理 Accident treatment
14.1、发生重大伤亡及其他安全事故，劳务分包人应按有关规定立即上报有关部门并报告工程承包人，同时按国家有关法律、行政法规对事故进行处理。
In case of major casualties and other safety accidents, the labor subcontractor shall, in accordance with relevant regulations, immediately report to the relevant authority and the project contractor, and handle the accidents subject to relevant national laws and administrative regulations.

14.2、劳务分包人和工程承包人对事故责任有争议时，应按相关规定处理。
If the labor subcontractor and the project contractor have disputes over the accident responsibility, they shall be handled according to relevant regulations.

15、保险 Insurance
15.1、劳务分包人施工开始前，工程承包人应获得发包人为施工场地内的自有人员及第三人人员生命财产办理的保险，且不需劳务分包人支付保险费用。 The project contractor shall, prior to the commencement of construction by the labor subcontractor, effect the insurance for the life and property of the employer's own personnel and the third personnel in the construction site without the premium paid by the labor subcontractor is required.

15.2、运至施工场地用于劳务施工的材料和待安装设备，由工程承包人办理或获得保险，且不需劳务分包人支付保险费用。 The materials and equipment to be installed which transported to the construction site for labor construction shall be effected insurance by the engineering contractor without the premium paid by the labor subcontractor.

15.3、工程承包人必须为租赁或提供给劳务分包人使用的施工机械设备办理保险，并支付保险费用。工程承包人自行投保的范围（内容）为： The project contractor should effect insurance of the construction machinery and equipment leased or provided to the labor subcontractor and pay the premium therefor. The scope (content) of the project contractor's own insurance is:

15.4、劳务分包人必须为从事危险作业的职工办理意外伤害保险，并为施工场地内自有人员生命财产和施工机械设备办理保险，支付保险费用。劳务分包人自行投保的范围（内容）为： The labor subcontractor should effect accident insurance and pay the premium for the employees being engaged in dangerous operations, and insurance for its own personnel life, property, construction machinery, equipment in the construction site. The scope (content) of the labor subcontractor's own insurance is:

15.5、保险事故发生时，劳务分包人和工程承包人有责任采取必要的措施，防止或减少损失。 Where an insurance accident occurs, the labor subcontractor and the project contractor have the responsibility to take necessary measures to prevent or reduce losses.
20、施工机具、周转材料供应 Supply of construction machinery, turnover materials
20.1 工程承包人提供给劳务分包人劳务作业使用的机具、设备，性能应满足施工的要求，及时运入场地，安装调试完毕，运行良好后交付劳务分包人使用。周转材料、低值易耗材料（由工程承包人依据本合同委托劳务分包人采购的除外）应按时运入现场交付劳务分包人，保证施工需要。如需要劳务分包人运输、卸车、安拆调试时，费用另行约定。 The performance of the machines and equipment provided by the project contractor to the labor subcontractor for labor operations shall meet the construction requirements. The machines and equipment shall be transported to the site in time, installed, debugged and delivered to the labor subcontractor for use after good operation. Turnover materials and low-value consumables (except those entrusted by the project contractor to the labor subcontractor purchasing according to this contract) shall be transported to the site to deliver the labor subcontractor subject to the time to ensure the construction needs. If the labor subcontractor is required to transport, unload, install, dismantle and debug, the expenses shall be separately agreed.

20.2 工程承包人应提供施工使用的机具、设备一览表见附件二。
The list of the machines, tools and equipment which provided by the project contractor for use in the construction as shown in Annex 2.

20.3、工程承包人应提供的周转材料、低值易耗材料一览表见附件三。
The list of the turnover materials and low-value consumables which provided by the project contractor as shown in Annex 3.
21、施工变更
Construction amendment
21.1 施工中如发生对原工作内容进行变更，工程承包人项目经理应提前7天以书面形式向劳务分包人发出变更通知，并提供变更的相应图纸和说明。劳务分包人按照工程承包人（项目经理）发出的变更通知及有关要求，进行下列需要的变更： In case of any change to the original work content during the construction, the project manager of the project contractor shall send an amend notice in writing to the labor subcontractor 7 days in advance, and provide the corresponding drawings and explanations thereof. The labor subcontractor shall, pursuant to the amend notice issued by the project contractor (project manager) and relevant requirements, make the following necessary changes:

(1) 更改工程有关部分的标高、基线、位置和尺寸； Change the elevation, baseline, location and size of relevant parts of the project;

(2) 增减合同中约定的工程量； Increase or decrease the quantities which stipulated in the contract;
?
(3) 改变有关的施工时间和顺序； Change the relevant construction time and sequence;
?
(4) 其他有关工程变更需要的附加工作。 Other additional works required for engineering amendment.

21.2 因变更导致劳务报酬的增加及造成的劳务分包人损失，由工程承包人承担，延误的工期相应顺延；因变更减少工程量，劳务报酬应相应减少，工期相应调整。 The project contractor shall bear the increase of labor remuneration and the loss of labor subcontractors caused by the change, and the delayed construction period shall be postponed accordingly. Due to the change to reduce quantities, labor remuneration should be reduced accordingly, and the construction period should be adjusted accordingly.

21.3 施工中劳务分包人不得对原工程设计进行变更。因劳务分包人擅自变更设计发生的费用和由此导致工程承包人的直接损失，由劳务分包人承担，延误的工期不予顺延。 The labor subcontractor shall not, during the construction, change or amend the original engineering design. The expenses which incurred by the labor subcontractor in changing the design without authorization and the direct losses shall be borne by the labor subcontractor and the delayed construction period shall not be postponed.

21.4 因劳务分包人自身原因导致的工程变更，劳务分包人无权要求追加劳务报酬。
The subcontractor have no right to request additional compensation for labor services due to engineering changes caused by itself reason.
